E-Nivaran – Online Grievance Redressal Mechanism for Income Taxpayers

PM Narendra Modi vision is described as bringing structural changes. The change was perhaps needed at the income tax grievance redressal mechanism also.  The change to make the redressal mechanism taxpayer friendly and cover all aspects of taxation. E-Nivaran Online Grievance Redressal Mechanism is a one stop, tech-driven grievance mechanism aims to curtail time and increase efficiency.

The income tax department had launched this special electronic grievance mechanism called E-Nivaran. E-Nivaran will integrate all the online and physical complaints received by the department. These will further be monitored by the Assessing Officer of the case up to the supervisory officers.

It is a dedicated one stop grievance redressal system that operates under the supervision of an assessing officer or supervisor officer. CBDT (Central Board of Direct Taxes) had also brought a new mechanism where top officers of the department have been allotted a specific quota of complaints. The officers’ monitor and track complaint, from their origin to successful resolution.

The mechanism has been living up to its name – Nivaran means redressal or providing a solution. Previously such dealings with tax authorities required manual filling of letters, appointments & several follow ups. One has to keep paper records of last orders, meetings, and correspondences. For resolution, there was no consolidated report or register where the grievances could be listed.  A full time 24 by 7 redressal mechanism was sorely missed.

Of late the income tax department has started making use of technology to ease taxpayers problems. Where earlier grievances were submitted at CPC- ITR, CPC- TDS or ASK (Aayakar Sampark Kendra), NSDL, UTI-ISL and through the e-filling portal. E-Nivaran has now integrated all these modules.

If you do not have PAN

E-Nivaran can be used by taxpayers to file and view their grievances. It is worthwhile to note that even a person who does not have a PAN/TAN number can file grievances. A person with PAN or TAN needs to click on E-Nivaran tab top right end corner on the income tax portal.E-Nivaran online grievance redressal mechanism

If you have PAN or TAN

Further, an individual with a pan or tan needs to login to the income tax portal. Click the E-Nivaran tab in the E-Nivaran form.

After you log in, the same screens appear as in the case of non-PAN or TAN complains.

Steps to register a grievance:

  1. Personal details: The section will seek the taxpayer’s name, PAN, address, mobile number, and email. If details are not pre-existing, one would be redirected to the profile details page. You can update details and proceed.
  2. Grievance type: The taxpayer will be required to select the type and subtype of the grievance from the drop-down list given below. He is also required to select the financial year and assessment year with reference to the grievance.
  3. Grievance Description: Here he will have to provide the description of the grievance (not more than 3000 characters).
  4. Documents to be uploaded: The aggrieved can upload the documents (not more than 5MB) relating to the grievance. The files that would be uploaded should be in pdf format and should be named as the PAN number of the assessee. This is an optional field.

When you click on Submit, to validate the authenticity of your request, an OTP will be sent to your registered mobile number and Email Id. Authorize the grievance by entering the necessary details and click on Validate. You also have an option to download a PDF copy of this grievance by clicking on Download Submitted e-Nivaran form.

Types of grievances at E-Nivaran

  • Your complaints addressed to assessing officer or supervisory related to income tax returns filed tax refunds, rectification, applications and for outstanding tax demand.
  • Queries addressed to e-filing websites team with reference to registration password related issues on the income tax returns.
  • Problems addressed to NSDL UTITSL with reference to discrepancies and issues related to pan applications.

Exclusions

E-Nivaran does not consider grievance related to the right to information. RTI matters court related/subjudice matters, grievance foreign government and grievance of government employees concern service matters, including discipline matters etc.

The smart electronic platform is expected to benefit taxpayers as there are flexibility and saving of time. For you, as a complainant submitting issues online and for follow up there is a smooth flow of information. It serves as written proof and for easy availability for future investigations. There is a faster resolution as all matters are tracked income place, and the aggrieved is kept posted through SMS and emails.

Through this new initiative, E-Nivaran has already managed to build faith amongst taxpayers in the short period. Taxpayers are assured that their issue is being considered. You must have already filed or in process of filing returns for AY 2017-18. In case you have an issue related to the income tax processes or department, you may use the system. The system is operational and expected to provide swift resolutions to most taxpayer grievances.
